Romanian TIR driver naked near cab in Italy, a woman called the police, a prosecutor sent him to trial

The Romanian had parked the truck in a resting space between Fano and Pesaro in the Marche region and was surprised by the, and after the woman complained to her a prosecutor filed a criminal record for obscene acts in public.

The woman who denounced the Romanian had no contact with the man, did not know his identity, and he had no idea that he had been seen by her and that he would be investigated for it.

The police were able to find the TIR first, using surveillance cameras, then also discover the identity of the driver, a 58-year-old Romanian citizen. The case went to the Pesaro Prosecutor’s Office, and upon completion of the investigation the driver was put on trial.

Romanian driver seen naked found not guilty

On 14 November, the Romanian was able to prove, with the help of his lawyer, that it was just a misunderstanding and that he did not intend for a moment to offend anyone.

“My client was seen naked, with his pants off, but he had just returned from the sea and was changing his wet clothes. Currently, the obscene act in public no longer constitutes a criminal offence, except when it is done in the presence of minors.

But the woman was alone and there were no other witnesses. It wasn’t even near a place frequented by minors, like a school. That’s why I asked for him to be acquitted. Possibly it falls within the scope of an administrative crime,” the Italian newspaper quoted the Romanian’s lawyer, Olindo Dionisi, as saying.

We are pleased that there has been an enlightenment on a story that could have had serious consequences for my client, but which was in a context completely alien to the sexual sphere. He was simply changing his clothes and didn’t think he would be seen in that circumstance.

The prosecutor in charge of the case demanded that the Romanian driver be convicted of obscene acts in public, but the judge at the Pesaro Court declared him not guilty.
